Conditions for Use of the TACF dentataBASE

The American Chestnut Foundation ("TACF") has created the TACF dentataBASE, an on-line database with detailed information concerning the location and details of, but not limited to: any planted chestnut trees as part of TACF's breeding program, any wild trees identified through TACF's network, any observational data collected on those trees, records of pollination and/or other manipulation of that germplasm, as well as the names and addresses of members, orchard managers and volunteers. The TACF dentataBASE is provided as a service to affiliated state Chapters, members, volunteers, and partners of The American Chestnut Foundation.

The purpose of the TACF dentataBASE is to encourage collaboration and accurate data management among everyone involved in the restoration of the American chestnut to the eastern hardwood forest. It is intended for research, personal and/or educational use only and may not be used in connection with any commercial use.

Conditions for Use Agreement

Please read the following carefully before you proceed.

By using the TACF dentataBASE, you agree to be bound by these Conditions for Use. TACF reserves the right to revise the Conditions for Use at any time, with notice of the revisions posted on the TACF dentataBASE. Continued use of the TACF dentataBASE serves as acceptance of the changed Conditions.

All content of the TACF dentataBASE is the property of TACF. You may not take data from the TACF dentataBASE search results and publish or distribute data, or analyses of data, in any way or fashion without prior written permission from TACF's President & CEO. ¹

By registering for and using the TACF dentataBASE, I agree to the following Conditions:

1. I agree that by accessing the TACF dentataBASE, I am being provided access to personally identifiable information, such as names and contact information for members, volunteers and prospects, and access to identifiable geographic/location data. I understand that the reputation TACF and its affiliated state Chapters and the many members and volunteers associated with these organizations may be impacted by the way I use, distribute, and dispose of the data I might access through using the TACF dentataBASE.

2. I agree not to use any personally identifiable information or geographic/location data to which I have access through the TACF dentataBASE in a way that is not necessary for my role as a member, volunteer, partner, or staff person of TACF. Before contacting any landowner or orchard manager, or visiting any location stored in the TACF dentataBASE, I agree that I will coordinate with my local TACF Regional Science Coordinator to ensure that any contact or visitation will be acceptable to the landowner or orchard manager.

3. I agree that TACF has no liability for any inaccuracies that may be contained in the TACF dentataBASE, including but not limited to geographic information, structure of the database, or observations on any entity within the system.

4. I agree that I will always show respect and courtesy when using TACF dentataBASE and when working or communicating with the TACF staff, affiliated state Chapters, members, volunteers, and partners.

5. I agree that I will always use my real name and real contact information when using the TACF dentataBASE, and when communicating with persons whose contact information I have received from the TACF dentataBASE.

6. I agree that I will never distribute data from the TACF dentataBASE, or analyses of such data, to a third party without written approval from the TACF's President and CEO. Even if approved, I will work to assure that the privacy policy of that third party is sufficient to protect the interests of TACF, its affiliated state Chapters, and their members and volunteers.

7. I agree that I will not attempt to access any information beyond my permissions, roles, and current affiliation with TACF. Should I wish to gain additional privileges within the system, I will contact my local TACF Regional Science Coordinator with that request.

8. I agree that I will not use the tools or data from the TACF dentataBASE for any commercial purposes or any solicitation on behalf of myself or others that represents a commercial purpose.

9. I agree that I will only use the TACF dentataBASE to advance the mission of TACF and its affiliated state Chapters. I will only enter real data related to TACF and/or its affiliated state Chapter efforts and projects.

10. I agree that I will not permit others to use the TACF dentataBASE while assuming my identity, and that I will not share my username and password with anyone.

11. I agree that I will log out after accessing the TACF dentataBASE on a computer when in a public place, or when using a computer not exclusively used by me.

12. I agree that I will "lock" access to my computer if there is any possibility a user other than myself could see the TACF dentataBASE when I step away from my computer.

13. I agree that I will always indicate that I represent TACF and/or its affiliated state Chapters when communicating with people whose contact information I have accessed through the TACF dentataBASE.

14. I agree that I will always destroy any data I have downloaded and used for a purpose such as mailing or e-mailing. I understand that a person can unsubscribe or "opt-out" at any time from the centralized system, and that I will not send e-mail to that person after they "opt-out."

15. I agree that I will not use or contribute copyrighted material to the TACF dentataBASE unless the copyright is owned by me or that I have obtained all necessary licenses and/or approvals.

16. I agree that I will not willfully make any harmful contributions to the TACF dentataBASE, including, without limitation: hacking, the introduction of computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious code or software.

17. I agree that I am solely responsible for the content of my contributions.

18. I agree that any comments or information I contribute to the system will give my views and will not necessarily reflect the views of TACF or any of its affiliated state Chapters.

19. I agree that TACF and its affiliated state Chapters are not responsible for the contents, accuracy or validity of any contribution that I may make to the TACF dentataBASE.

20. I agree that TACF and its affiliated state Chapters have the right at their sole discretion to remove or modify any material in the TACF dentataBASE, including material that I may have contributed, without my prior consent.

21. I agree that I will not contribute any information that is or is likely to be, discriminatory, hateful, false, inaccurate, threatening, defamatory, abusive, obscene, indecent, seditious, offensive, pornographic, harassing, profane, sexually oriented, invasive of a person's privacy, or which may cause annoyance or inconvenience or otherwise be a breach of the law.

22. I agree to notify the system administrators and responsible officers forthwith if I detect any issue with the system, including technical issues or data management errors.
